Terms of Use

1. Agreement

These terms are an agreement between you and the developer of SmsPdf ("we"). They cover the SmsPdf app for iPhone and the website smspdf.com (together, the "Service"). By installing or using the app you accept them. If you do not agree, please do not use the Service.

The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to it. Where the two conflict on a matter the Standard EULA requires, the Standard EULA applies.

2. The Service

SmsPdf reads screenshots and screen recordings of chats that you provide and turns them into a conversation you can review, edit and export as a PDF, a spreadsheet or plain text. To read the text, images are uploaded to our server as described in the Privacy Policy. The app needs an internet connection for this step.

We may change, limit or stop features, and we apply daily usage limits to keep the Service available to everyone.

3. Accuracy

Recognition is automatic. It can miss messages, misread words, names, dates or times, or put messages in the wrong order. Review every conversation against the original chat before you export or rely on it, and keep the original chat.

SmsPdf is not a legal service and does not give legal advice. We do not promise that a document will be accepted by a court, a government body, an insurer or anyone else. Rules on evidence differ by place and case; ask a lawyer.

4. Your content and your responsibility

You keep all rights in the conversations you import and the documents you create. You give us permission to process them only as needed to provide the Service.

You are responsible for making sure that you have the right to capture, import, store and share a conversation, including the messages and personal details of other people in it, and that your use follows the laws that apply to you.

The app lets you edit messages, names, dates and times so you can correct recognition mistakes. You must not use the Service to create false or misleading records, or present an altered conversation as a true copy of the original.

5. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to harass, stalk or harm another person;
• import content you have no right to use;
• reverse engineer the app, bypass its limits, or access our servers other than through the app;
• overload, probe or disrupt the Service, or resell it.

6. Subscriptions and payments

• Some features, such as exporting, sharing and printing, need a paid subscription. The plans, prices and any free trial are shown in the app before you buy.
• Payment is charged to your Apple Account when you confirm the purchase.
• A subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within 24 hours before the period ends.
• You can manage or cancel a subscription at any time in your Apple Account settings on your device. Deleting the app does not cancel it. After you cancel, paid features stay available until the end of the period you have paid for.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• Purchases are handled by Apple, so refunds are decided by Apple under its policies. You can ask for one at reportaproblem.apple.com.
• We may change prices for future periods. Apple will notify you, and ask for your consent where that is required, before a new price applies to you.

Nothing in this section limits rights you have under the consumer protection laws of your country.

7. Our rights

The app, its design, text, graphics and code belong to us or our licensors and are protected by law. Apart from the license to use the app, these terms give you no rights in them. Names and logos of messaging apps mentioned in the Service belong to their owners; SmsPdf is not affiliated with or endorsed by them.

8. Ending use

You can stop using the Service at any time by deleting the app; remember to cancel any subscription separately. We may suspend or end access to the Service if you seriously or repeatedly break these terms, or if we have to do so by law.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability.

10. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, for lost data or profits, or for any result of relying on a document made with the Service. Our total liability for any claim about the Service is limited to the amount you paid for it in the 12 months before the claim.

Some countries do not allow these limits. In that case they apply only as far as your law permits, and nothing in these terms removes liability that cannot be excluded by law.

11. Changes to these terms

We may update these terms. The new version will be posted on this page with a new effective date. If the changes are significant, we will also tell you in the app. Continuing to use the Service after the effective date means you accept the new terms.

12. General

If a part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term, that is not a waiver of it. Mandatory consumer protection laws of the country where you live always apply to you.
